You can use <a href=\"https:\/\/www.judiciary.gov.sg\/services\/elitigation\">eLitigation <\/a>to submit the power of attorney and accompanying documents. If you don&#8217;t have an eLitigation account, you can file it in person at the <a href=\"https:\/\/www.judiciary.gov.sg\/services\/elitigation#location\">LawNet &amp; CrimsonLogic Service Bureau<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-are-the-types-of-power-of-attorney-poa-available-in-singapore\"><strong>What are the types of Power of Attorney (POA) available in Singapore?&nbsp;<\/strong><\/h2>\n\n\n\n<p>The following are 5 types of POAs, each serving different purposes;&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>\u00a0General Power of Attorney\u00a0<\/strong><\/li>\n<\/ol>\n\n\n\n<p>If the POA agreement does not clearly outline the donee&#8217;s authority in particular situations, then the general POA allows the donee to represent the donor in all cases.&nbsp;<\/p>\n\n\n\n<p>With a general POA, the donee has the power to perform various tasks, such as engaging in legal and financial transactions, handling property, signing contracts for the donor, submitting tax returns, and other related duties.&nbsp;<\/p>\n\n\n\n<p>A general POA remains effective unless it is cancelled in the following instances;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Revocation by the donor&nbsp;<\/li>\n\n\n\n<li>Death of the donor<\/li>\n\n\n\n<li>Incapacity of the donor<\/li>\n\n\n\n<li>Or when a particular event is specified in the POA.<\/li>\n<\/ul>\n\n\n\n<ol class=\"wp-block-list\" start=\"2\">\n<li><strong>Specific Power of Attorney\/ Non-Durable Power of Attorney<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Under this type of POA, the donee is authorised to act on behalf of the donor but only in the designated areas. A special POA can be revoked in similar ways to a general POA.<\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"3\">\n<li><strong>Lasting Power of Attorney (LPA)<\/strong><\/li>\n<\/ol>\n\n\n\n<p>An individual can use the LPA to give legal authority to a donee to manage their affairs in the case of a loss of mental capacity. In Singapore, the LPA is regulated by the Mental Capacity Act.&nbsp;<\/p>\n\n\n\n<p>The LPA permits the donee to make decisions on behalf of the donor regarding their personal, financial, and property matters when the donor cannot do so. By having an LPA, the donor and their family can avoid potential uncertainty and issues arising from mental incapacity.&nbsp;<\/p>\n\n\n\n<p>To ensure that the donor understands the purpose and consequences of the LPA, the certificate issuer must confirm that the LPA is valid and was created without any fraud, coercion, or undue pressure.<\/p>\n\n\n\n<p>Follow these general steps to create an LPA:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Complete the LPA application by selecting a trusted donee who is at least 21 years old and specifying the powers to be granted.<\/li>\n\n\n\n<li>Obtain certification from an LPA certificate issuer (E.g., a practising lawyer, a psychiatrist, or an accredited medical practitioner)<\/li>\n\n\n\n<li>Submit the completed LPA application to the Office of the Public Guardian.<\/li>\n<\/ul>\n\n\n\n<ol class=\"wp-block-list\" start=\"4\">\n<li><strong>HDB Power of Attorney<\/strong><\/li>\n<\/ol>\n\n\n\n<p>The Housing and Development Board (HDB) POA is the most common type of POA in Singapore. It is required when a homebuyer is unable to attend the appointment to collect their keys or appear in person for the signing of various documents, including;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Sales Contract<\/li>\n\n\n\n<li>Lease Contract<\/li>\n\n\n\n<li>Option to Purchase Agreement<\/li>\n\n\n\n<li>Deed of Assignment<\/li>\n\n\n\n<li>Lease in Escrow<\/li>\n\n\n\n<li>and Mortgage in Escrow\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Individuals located overseas who cannot sign legal documents in Singapore will also use HDB POAs, typically by hiring a lawyer to act on their behalf. The POA will outline the specific rights granted to the attorney, such as the authority to complete transactions, sign documents, and return funds to the CPF Board.<\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"5\">\n<li><strong>Conditional or Springing Power of Attorney (POA)<\/strong><\/li>\n<\/ol>\n\n\n\n<p>The Springing POA, also called the Conditional POA, is a type of POA that is activated only when a specific event occurs. During the creation of the POA, it is important to define the specific event that will trigger the activation of the POA. For example, the POA may grant authority to the donee only when the donor is located overseas.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-can-the-power-of-attorney-poa-be-revoked\"><strong>Can the Power of Attorney (POA) be revoked?<\/strong><\/h2>\n\n\n\n<p>Yes, the POA can be terminated, especially if you are unsatisfied with the quality of service or results provided by your donee.<\/p>\n\n\n\n<p>Prepare a revocation document and distribute copies to all relevant transaction entities, such as hospitals and banks.
