Sometimes condo residents get frustrated at their <a href=\"https:\/\/www.99.co\/singapore\/insider\/mcst-management-corporation-strata-title\/\" target=\"_blank\" rel=\"noopener\">management corporation (MCST)<\/a>, and vice versa. Most time these conflicts result in a bunch of angry emails, questionable legal threats, and a lot of eye injuries (from eyeballs rolled so far back they get stuck). <strong>Once in a while, however, disputes between condo MCST and residents escalate and become so ridiculous they make it to the news, such as these epic incidents:<\/strong><\/span><\/p>\n<ol>\n<li>\n<h3><b> Mandarin Gardens fights itself until literally everyone gives up<\/b><\/h3>\n<\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Back in 2008, Mandarin Gardens was the site of a major showdown. We are giving you <\/span><a href=\"http:\/\/forums.condosingapore.com\/showthread.php\/2450-Mandarin-Gardens-management-panel-steps-down-over-enbloc-disputes\" target=\"_blank\" rel=\"nofollow noopener\"> <span style=\"font-weight: 400;\">this link<\/span><\/a><span style=\"font-weight: 400;\"> because the one at Channel NewsAsia has since been taken down; this is the replicated news report.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In that year, two major things happened. First, the Global Financial Crisis, brought about by Americans, mistakenly believed that mortgage payments were optional. Second, the resulting collapse saw the US Federal Reserve reduce interest rates to zero, which made Singaporean mortgages crazy cheap. <\/span><span style=\"font-weight: 400;\">(We are not kidding about \u201ccheap\u201d. At one point, the SOR, or Swap Offer Rate, fell so low it was in <\/span><a href=\"http:\/\/www.reuters.com\/article\/singapore-sor-idUSL3E7JF0F020110817\" target=\"_blank\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">negative territory<\/span><\/a><span style=\"font-weight: 400;\">. If not for a minimum rate clause, the banks would have had to <em>pay you<\/em> for taking a home loan).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Anyway, this led to a property fever.\u00a0<\/span><a href=\"https:\/\/www.99.co\/singapore\/condos-apartments\/mandarin-gardens\" target=\"_blank\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">Mandarin Gardens<\/span><\/a><span style=\"font-weight: 400;\">, which was built in 1986 and getting a little old, had en bloc potential. The residents who really wanted an en bloc sale formed a proxy collective sales committee and had a <em>really<\/em> good idea of how to make the sale go through.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">That idea was to have a frank discussion with the residents to arrive at a consensus maturely \u2014 <em>said no one ever<\/em>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Instead, the\u00a0proxy committee decided that there was a shortcut to making the en bloc sale go through if they all collaborated to turn Mandarin Gardens into the garbage dump of the East.<\/strong> Then, no one would want to live there and residents would be compelled to accept an en bloc offer \u2014 problem solved.<\/span><\/p>\n<p><img decoding=\"async\" class=\"aligncenter size-full wp-image-18548\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2017\/11\/condo-msct-rubbish-dump.jpg\" alt=\"Condo MCST rubbish dump\" width=\"720\" height=\"480\" srcset=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2017\/11\/condo-msct-rubbish-dump.jpg 720w, https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2017\/11\/condo-msct-rubbish-dump-440x294.jpg 440w\" sizes=\"(max-width: 720px) 100vw, 720px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">To pull this off, the proxy committee tried to convince everyone that the maintenance fee charged by the condo management was too high and should be reduced. The conniving group of residents then went around collecting votes.<\/span><\/p>\n<p>It was no small reduction in maintenance fee. <em>In fact, it was to be cut from $300,000 to $50,000<\/em><span style=\"font-weight: 400;\"><em>.<\/em> And the proxy committee argued \u2014 with a straight face \u2014 that reducing maintenance to <\/span><span style=\"font-weight: 400;\">one-sixth <\/span><span style=\"font-weight: 400;\">of the norm was not a plan to drive the place to ruin. In response, the condo MCST<\/span><span style=\"font-weight: 400;\"> resigned en masse, leaving the estate with zero management. During this time, approvals for upgrading and maintenance did not happen as there was no one to approve them \u2014 the condo really started turning into a dump.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Later on, the proxy committee gave up on the en bloc attempt, not before proving to everyone how selfish and obnoxious they were.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>TL;DR:<\/strong> A bunch of people tried to turn their own home into a rubbish dump to force a sale, and accomplished everything except making the sale.<\/span><\/p>\n<ol start=\"2\">\n<li>\n<h3><b> A condo MCST decides it\u2019s okay for kids to risk death<\/b><\/h3>\n<\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Back in 2015, the Strata Titles Board <\/span><a href=\"http:\/\/www.asiaone.com\/singapore\/family-wins-case-install-grille-condo-balcony-childs-safety\" target=\"_blank\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">made an important decision<\/span><\/a><span style=\"font-weight: 400;\">\u00a0to prioritise the safety of children over preserving the aesthetics of a condo facade.\u00a0<\/span>You see, over in\u00a0<a href=\"https:\/\/www.99.co\/singapore\/condos-apartments\/one-north-residences\" target=\"_blank\" rel=\"noopener\">One North Residences<\/a>, a family had a potentially deadly problem. Their four-year-old daughter was seen climbing the balcony home on the 13th floor. Just to be clear, here\u2019s what the balconies look like (notice the louvres on the right end of the balcony that look like they are made for climbing).<\/p>\n<p><img decoding=\"async\" class=\"aligncenter size-full wp-image-18547\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2017\/11\/condo-msct-one-north-residences-balcony.jpg\" alt=\"Condo MCST One North Residences Balcony\" width=\"720\" height=\"481\" srcset=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2017\/11\/condo-msct-one-north-residences-balcony.jpg 720w, https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2017\/11\/condo-msct-one-north-residences-balcony-440x294.jpg 440w\" sizes=\"(max-width: 720px) 100vw, 720px\" \/><\/p>\n<p><span style=\"font-weight: 400;\"><strong>When the concerned family asked the condo MSCT for permission to install a safety grille on the balcony, it was flat out rejected.<\/strong> Their stand was that the family could set up a grille in the living room that would block access to the balcony, but no way could they, or anyone else, put grilles on that exquisite balcony as doing so would affect the condo facade&#8217;s aesthetics.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Well, if there is one thing that overrides the safety of children, we suppose it is keeping glass and concrete buildings uniform (as if a valuer will look at the condo and insist the property value has been destroyed by balcony grilles). The condo management turned down the<\/span><span style=\"font-weight: 400;\">\u00a0family&#8217;s request for permission <\/span><i><span style=\"font-weight: 400;\">twice <\/span><\/i><span style=\"font-weight: 400;\">before the family finally appealed\/complained to the <a href=\"https:\/\/www.stratatb.gov.sg\/\" target=\"_blank\" rel=\"noopener\">Strata Titles Board<\/a>. Fortunately, common sense prevailed as the Board overruled the condo MCST.<\/span><\/p>\n<p><strong>TL;DR:<\/strong> To maintain the aesthetics of the building facade, a condo&#8217;s management had forbade owners to install safety grilles in their balconies \u2014 lopsided to ensure their childrens&#8217; safety.<\/p>\n<ol start=\"3\">\n<li>\n<h3><b> A condo MCST finds inspiration\u2026 from debt collectors<\/b><\/h3>\n<\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">[The original clip in The New Paper has vanished, but it dates back to 2010, and this\u00a0<\/span><a href=\"https:\/\/www.respore.com\/condo-cheapos-shamed\/\" target=\"_blank\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">link<\/span><\/a><span style=\"font-weight: 400;\"> reproduces it.]<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Plenty of condo management corporations have issues with late-paying residents; maintenance fees are not cheap in a condo. The usual methods of it are charging interest, sending threatening legal letters, or outright guilt-tripping the resident (&#8220;<\/span><i><span style=\"font-weight: 400;\">Hey, is that a new wide-screen TV? We\u2019ll just tell the cleaner with two children she won\u2019t be paid because you need that. Enjoy your Christmas. Her children won\u2019t&#8221;.)<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">But the condo MSCT of\u00a0<\/span><a href=\"https:\/\/www.99.co\/property\/YdgchZaFG6rfohqFSJS2bM\"><span style=\"font-weight: 400;\">Castle Green<\/span><\/a><span style=\"font-weight: 400;\"> went one big step further. <strong>The condo managing agent straight up plastered the names of people who owed money \u2014 along with the amounts owed \u2014 on notice boards all around the condo.<\/strong> The justification was that such a method &#8220;worked in other condos\u201d.<\/span><\/p>\n<p><img decoding=\"async\" class=\"aligncenter wp-image-18550\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2017\/11\/condo-msct-debt-collector.jpg\" alt=\"\" width=\"720\" height=\"474\" \/><\/p>\n<p><span style=\"font-weight: 400;\">Now, before you decide these residents all deserved to be shamed, remember these mitigating factors. One of the residents never even lived there \u2014 she was divorced, and her husband was the one who agreed to make payments (but did not). Another resident claimed he never even got any letters or invoices, barring a last-minute reminder.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On top of all this, condos typically charge a high interest rate for late payment, ranging from 10 to 15% per year. It is not uncommon for some owners to just accept the interest rate and pay a month or two later. It happens all the time, such as when landlords have problem tenants who have not paid up.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So, most management corporations accept late payments do occur and work <\/span><i><span style=\"font-weight: 400;\">with <\/span><\/i><span style=\"font-weight: 400;\">the residents. While there is perhaps some hidden merit in a gung-ho, <\/span><span style=\"font-weight: 400;\">adversarial <\/span><span style=\"font-weight: 400;\">style of condo management, we all know how well things turn out if you get aggressive with people who have the <em>power to fire you<\/em>.<\/span><\/p>\n<p><strong>TL;DR:<\/strong> Condo management deploys loan shark style tactics to name and shame residents who defaulted on their maintenance fees.<\/p>\n<ol start=\"4\">\n<li>\n<h3><b> A management committee decides to sue its own residents&#8230; using estate funds<\/b><\/h3>\n<\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">This is a recent case. In 2017, the\u00a0<\/span><a href=\"https:\/\/www.99.co\/singapore\/condos-apartments\/neptune-court\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Neptune Court<\/span><\/a><span style=\"font-weight: 400;\">\u00a0management committee was ordered\u00a0<\/span><a href=\"http:\/\/www.straitstimes.com\/singapore\/courts-crime\/neptune-court-committee-must-repay-estate-fund?login=true\" target=\"_blank\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">to refund $420,000<\/span><\/a><span style=\"font-weight: 400;\"> to the condo&#8217;s estate fund after it was ruled to have &#8220;misspent&#8221; the sun of money by launching a failed lawsuit. Here&#8217;s the twist: the money was used to sue its own residents.<\/span><\/p>\n<p>You see, the committee was getting the estate privatised in 2012 by buying land and common areas from the Ministry of Finance. In response, 26 residents put up questions for the committee regarding this ahead of the Annual General Meeting (AGM). The committee took offence at the phrasing of these questions and promptly sued the group of residents. These were the questions:<\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Who would pay for that land, and<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Would residents please give their considerations on the income and expenditures for the budget that year, and the following year?<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Now look closely at those questions and see if you can spot where they are defamatory or offensive. No? That is because spotting the defamatory part is like seeing one of those Magic Eye pictures, except you are also blind while you are trying. We certainly could not see it; neither did the High Court, apparently, because it ruled there <i>was<\/i> no defamatory meaning.<\/span><\/p>\n<p>The management committee also decided that it was a good idea to pay for the lawsuit&#8217;s legal expenses using the estate&#8217;s funds and do so without going through the due process of an internal vote. <strong>They also sneakily decided to park the legal costs of $427,700 under &#8220;privatisation fees&#8221;.<\/strong> Now it has to pay $420,000 back, by hook or by crook.<\/p>\n<p>Perhaps the surprisingly (or unsurprisingly), the outgoing president of the wretched committee told the Straits Times that the decision to sue was to &#8220;protect the committee&#8217;s integrity&#8221; and &#8220;not for personal reason&#8221;. Right.<\/p>\n<p><strong>TL;DR:<\/strong> A management committee sued its residents for defamation using estate funds, failed miserably, and is ordered to pay the funds back.<\/p>\n<p><em>Know of any other epic condo MCST vs resident disputes?
