Condos across Singapore vary in their by-laws, and it\u2019s important to check how the condo you\u2019re considering deals with matters such as security, garbage disposal, common areas and more. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Consider this: in a notable incident that happened a few years back, Sharlane Foo, a resident at City Square wasn\u2019t allowed to enter the condo because she had forgotten her access pass. While Sharlane showed the security officer her IC \u2014 which contained her City Square residence address \u2014 the officer refused to let her through. She requested for a supervisor to step in, but the supervisor who arrived, too, did not allow her in.<\/span><\/p>\n<figure id=\"attachment_22512\" aria-describedby=\"caption-attachment-22512\" style=\"width: 616px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\" wp-image-22512\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2018\/12\/Security-guard.jpg\" alt=\"\" width=\"616\" height=\"411\" \/><figcaption id=\"caption-attachment-22512\" class=\"wp-caption-text\">Some security guards take their job WAY more seriously than you&#8217;d think.<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400;\">Sharlane had no choice but to repeatedly call her fiance, who was at home. Once he got her texts and missed calls, he rushed downstairs with her access pass. While the couple expected an apology from the guards, they were instead met with \u201can aggressive posture and swearing\u201d. The incident culminated in the security supervisor becoming violent and hitting Sharlane\u2019s fiance, and it\u2019s clear that this wasn\u2019t the right course of action.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Now, here&#8217;s the question: assuming the incident did <\/span><i><span style=\"font-weight: 400;\">not <\/span><\/i><span style=\"font-weight: 400;\">involve any violence, would it then be within the condo or guards\u2019 jurisdiction to deny Sharlane entry, or were they in the wrong?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Here\u2019s the answer: it all depends on the condo\u2019s by-laws.<\/span><\/p>\n<h3><b>What are condo by-laws?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">If you\u2019re not familiar with condo by-laws, these are stipulations that condo residents need to abide by. These are made for \u201ccontrolling and managing the use or enjoyment of common property and the lot\u201d in a condo or development. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">How does this work? In Singapore, the management of condominiums is governed under the Building Maintenance and Strata Management Act (BMSMA). Under the BMSMA, there are two sets of by-laws: one set that\u2019s outlined in the Second Schedule of the Building Maintenance (Strata Management) Regulations, and another set that can be established by each condo\u2019s management corporation.<\/span><\/p>\n<figure id=\"attachment_22513\" aria-describedby=\"caption-attachment-22513\" style=\"width: 612px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\" wp-image-22513\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2018\/12\/Stack-of-documents.jpg\" alt=\"\" width=\"612\" height=\"408\" \/><figcaption id=\"caption-attachment-22513\" class=\"wp-caption-text\">Condo by-laws can get surprisingly complex and extensive<\/figcaption><\/figure>\n<h3><b>Compulsory condo by-laws<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The compulsory by-laws set out in the Second Schedule of the Building Maintenance (Strata Management) Regulations primarily deal with: <\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Noise<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Parking of vehicles<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Obstruction of common property<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Damage to lawn, trees, shrubs, and other plants<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Alteration or damage to common property<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Behaviour of owners and residents<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Children playing on common property<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Behaviour of visitors<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Depositing rubbish and unwanted items on the common property<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Drying of laundry<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Cleaning windows<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Storage of flammable liquids<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Garbage disposal<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Keeping of animals<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Proper maintenance of lot<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Proper use of lot<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Change of use of lot<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Prevention of fire and other hazards<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Control of use of facilities<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Provision of amenities and services<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">These by-laws are fairly straightforward. For instance, the by-law concerning \u201cbehaviour of visitors\u201d states that residents should ensure that their visitors do not disturb the peace of the estate.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Should a condo resident breach a by-law, the condo\u2019s MC or other residents may apply to the court for an order to stop said resident from continuing to breach the by-law. In doing this, they may also recover damages (if applicable).<\/span><\/p>\n<h3><b>Additional condo by-laws<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The BMSMA dictates that a condominium\u2019s MC may make additional by-laws which fall under the following categories:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Safety and security measures<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Details of any common property of which use is restricted<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The keeping of pets<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Parking<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Floor coverings<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Garbage disposal<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Behaviour<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Architectural and landscaping guidelines to be observed by all subsidiary proprietors<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Such other matters as are appropriate to the type of strata scheme concerned<\/span><\/li>\n<\/ul>\n<figure id=\"attachment_22514\" aria-describedby=\"caption-attachment-22514\" style=\"width: 631px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\" wp-image-22514\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2018\/12\/Yellow-card.jpg\" alt=\"\" width=\"631\" height=\"421\" \/><figcaption id=\"caption-attachment-22514\" class=\"wp-caption-text\">Not every rule is a by-law<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400;\">That said, <strong>these additional by-laws may not contradict the compulsory by-laws. <\/strong><\/span><\/p>\n<p><span style=\"font-weight: 400;\">Where you have a dispute with your condo\u2019s by-laws (let\u2019s call this by-law A, for simplicity), and you find that A contradicts a compulsory by-law of BMSMA, you may move to have A repealed. <\/span><\/p>\n<h3><b>When is a condo regulation NOT a by-law?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The vast majority of by-laws require a Special Resolution to be passed. This means a general meeting has to be held; during this meeting, the condo residents who vote for the resolution have to make up at least 75% of the share value of all the valid votes cast at the meeting. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bearing this in mind, if your condo tries to impose any rules or regulations that haven\u2019t been brought up at a general meeting, this does NOT make up a by-law. Following in the same vein, if your condo tries to impose a rule that was brought up at a general meeting, but failed to get the majority (&lt;75%) vote, again, this does not count as a by-law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Note: there are some exceptions to this rule.
