Today, we&#8217;re looking at the <strong>Temporary Occupancy Permit (TOP)<\/strong>:<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-a-temporary-occupancy-permit-top\"><strong>What is a Temporary Occupancy Permit (TOP)?<\/strong><\/h2>\n\n\n\n<p>In the real estate scene in Singapore, TOP is commonly used to refer to the date that you can move into a newly completed development.<\/p>\n\n\n\n<p>More specifically, a <strong>Temporary Occupation Permit (TOP)<\/strong> is a permit that allows homeowners to occupy the building while the key requirements are being met.<\/p>\n\n\n\n<p>For a building to be declared fit and ready for habitation (regardless if it&#8217;s an <a href=\"https:\/\/www.99.co\/singapore\/sale\/hdb\" target=\"_blank\" rel=\"noreferrer noopener\">HDB<\/a> or <a href=\"https:\/\/www.99.co\/singapore\/condos-apartments\" target=\"_blank\" rel=\"noreferrer noopener\">condo<\/a>), it needs to get the <strong><a href=\"https:\/\/www.bca.gov.sg\/TOPCSC\/topcsc_faqs.html\" target=\"_blank\" rel=\"noreferrer noopener\">Certificate of Statutory Completion (CSC)<\/a><\/strong> from the authorities. However, buyers are eager to move in sooner \u2013 the most eager being landlords, who are losing out on rental income for every day that the completion is delayed.<\/p>\n\n\n\n<p>Since it can take some time for the CSC to be granted, many developers will seek to get a <strong>Temporary Occupation Permit (TOP)<\/strong> instead.<\/p>\n\n\n<div class=\"wp-block-image wp-image-26235\">\n<figure class=\"aligncenter is-resized\"><img decoding=\"async\" width=\"1000\" height=\"667\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2019\/05\/moving-in-home-top.jpg\" alt=\"Asian couple play fighting inside their new home\" class=\"wp-image-26235\" style=\"width:700px;height:512px\"\/><figcaption class=\"wp-element-caption\">A property with a TOP means buyers can move in before it obtains its CSC.<\/figcaption><\/figure><\/div>\n\n\n<h2 class=\"wp-block-heading\"><b>Why is the Temporary Occupation Permit (TOP) needed?<\/b><\/h2>\n\n\n\n<p><strong>Short answer:<\/strong> TOP allows some flexibility in occupying a building before it is 100% completed, when it&#8217;s deemed safe to do so.<\/p>\n\n\n\n<p>For example, the movie hall extension of your condo&#8217;s clubhouse may not be finished yet, but that&#8217;s no reason you can&#8217;t move in or start taking tenants.<\/p>\n\n\n\n<p>But to get the CSC, every single tile of the development needs to be in place.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><img decoding=\"async\" width=\"1080\" height=\"810\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2019\/04\/MMJ-Design-Loft-The-Visionaire-Living-Room-Balcony-Reno-Before.jpg\" alt=\"temporary occupation permit\" class=\"wp-image-25539\" style=\"width:700px\" srcset=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2019\/04\/MMJ-Design-Loft-The-Visionaire-Living-Room-Balcony-Reno-Before.jpg 1080w, https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2019\/04\/MMJ-Design-Loft-The-Visionaire-Living-Room-Balcony-Reno-Before-380x284.jpg 380w\" sizes=\"(max-width: 1080px) 100vw, 1080px\" \/><figcaption class=\"wp-element-caption\">A Temporary Occupation Permit (TOP) lets buyers move into a new project as soon as possible.<\/figcaption><\/figure><\/div>\n\n\n<p><strong>Long answer: <\/strong>To ensure high standards of building quality are maintained, the&nbsp;<a href=\"https:\/\/www1.bca.gov.sg\/regulatory-info\/building-control\/application-for-temporary-occupation-permit-top\" target=\"_blank\" rel=\"noopener noreferrer\">Building and Construction Authority&nbsp;(BCA)<\/a>&nbsp;has put in place an extensive mix of requirements that all developers have to meet if they wish to build in Singapore.<\/p>\n\n\n\n<p>To make sure the requisites are indeed met, the BCA has designed a multitude of regulations, processes, and procedures involved in the planning, design, construction, and implementation of an industrial building development.<\/p>\n\n\n\n<p>When the entire process is concluded, the developer will apply for a CSC, and when granted, the buildings can, from that moment onwards, be legally occupied.<\/p>\n\n\n\n<p>Sometimes a situation arises where a subset of the development is ready to be occupied, while other parts are still under construction.<\/p>\n\n\n\n<p>Think of a development where the residential units have been completed, but there are common facilities such as the swimming pool that are still being worked on.<\/p>\n\n\n\n<p>Such circumstances lead to an opportunity where the completed units can be occupied, even though the development is not yet ready. This is where the TOP comes in.<\/p>\n\n\n\n<p>It allows the owners to move in earlier, and the developer to cater&nbsp;to prospective buyers who prefer to buy a unit that&#8217;s completed. Landlords can also start taking on tenants and generating rental income.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-top-allows-for-dps-schemes\"><strong>TOP allows for DPS schemes<\/strong><\/h3>\n\n\n\n<p>The&nbsp;<a href=\"https:\/\/www.99.co\/singapore\/insider\/property-jargon-of-the-day-deferred-payment-scheme\/\" target=\"_blank\" rel=\"noreferrer noopener\">Deferred Payment Scheme (DPS)<\/a>&nbsp;allows homeowners to pay for 20% of the property first and then the rest as late as two years later. This is a much-desired scheme among some buyers, as it allows them to <em>&#8220;escape&#8221;<\/em> two years of interest repayments (there&#8217;s no need to secure a bank loan until the remaining payment is due).<\/p>\n\n\n<div class=\"wp-block-image wp-image-17514\">\n<figure class=\"aligncenter is-resized\"><img decoding=\"async\" width=\"926\" height=\"377\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2017\/08\/saving-money-property.jpg\" alt=\"Property jargon: DPS\" class=\"wp-image-17514\" style=\"width:700px\"\/><figcaption class=\"wp-element-caption\">DPS allows you to pay for 20% of the property first, and then the rest of it as late as two years later.<\/figcaption><\/figure><\/div>\n\n\n<p>But properties that have yet to get their TOP cannot be sold under such schemes. As a result, many buyers and developers are eager to see their desired development get its TOP.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>CSC \u2013 TOP&#8217;s big brother&nbsp;<\/strong><\/h2>\n\n\n\n<p>So when talking about the TOP, you cannot go without talking about its big brother, the Certificate of Statutory Completion. Or put more dauntingly, the CSC. <\/p>\n\n\n\n<p>Intimately related, the CSC is another legal document which stipulates that a building can be occupied. <\/p>\n\n\n\n<p>While there are a few subtle differences, the CSC can simply be viewed as a more <em>permanent<\/em> version of the TOP.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><b>TOP and CSC: What&#8217;s the difference?<\/b><\/h3>\n\n\n\n<p><strong>There are two main differences between the TOP and the CSC.<\/strong><\/p>\n\n\n\n<p>The first difference is that while the TOP is <strong>optional<\/strong>, the CSC is compulsory.<\/p>\n\n\n\n<p>Second, for the CSC to be granted, there are many more hoops that the developer has to jump through compared to the TOP.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-quickly-can-a-developer-get-the-top\"><strong>How quickly can a developer get the TOP?<\/strong><\/h2>\n\n\n\n<p>Getting the TOP depends on how quickly construction on the essential parts of the development can be finished. Once the development is ready for inspection, the developer can <a href=\"https:\/\/www1.bca.gov.sg\/regulatory-info\/building-control\/application-for-temporary-occupation-permit-top\" target=\"_blank\" rel=\"noreferrer noopener\">apply for the TOP<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Application procedure<\/strong><\/h3>\n\n\n\n<p>As mentioned earlier, the responsibilities to apply for the TOP lie with the developer. But to give you an idea of what the TOP entails, here&#8217;s a summary of the steps involved.<\/p>\n\n\n<div class=\"wp-block-image is-style-default\">\n<figure class=\"aligncenter size-full is-resized\"><a href=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2022\/07\/workflow-to-obtain-TOP-by-BCA.jpg\" class=\"img-link media-img img-link media-img\"><img decoding=\"async\" width=\"760\" height=\"543\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2022\/07\/workflow-to-obtain-TOP-by-BCA.jpg\" alt=\"Workflow to apply for Temporary Occupation Permit by the Building and Construction Authority\" class=\"wp-image-55708\" style=\"width:700px\" srcset=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2022\/07\/workflow-to-obtain-TOP-by-BCA.jpg 760w, https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2022\/07\/workflow-to-obtain-TOP-by-BCA-150x107.jpg 150w\" sizes=\"(max-width: 760px) 100vw, 760px\" \/><\/a><\/figure><\/div>\n\n\n<ol class=\"wp-block-list\">\n<li>An inspection of the relevant buildings and premises will have to be arranged with the BCA. This responsibility lies with the developer who will appoint a \u201cqualified person\u201d (either a registered architect or professional engineer) to arrange and manage the site inspection.<\/li>\n\n\n\n<li>If the inspection was successful, then all the required documents and clearances from the other relevant technical authorities will have to be submitted and approved. This responsibility also falls on the developer.<\/li>\n<\/ol>\n\n\n\n<p>If all goes well during the inspection, the TOP can be granted in around four weeks.<\/p>\n\n\n\n<p>Pressed for time? There&#8217;s also an <strong><a href=\"https:\/\/www.bca.gov.sg\/TOPCSC\/top_inspection.html\" target=\"_blank\" rel=\"noreferrer noopener\">express TOP<\/a><\/strong> option, which allows developers to get the TOP within as little as one working day at a small fee of S$500 or S$1,000 (depending on the size of the project).<\/p>\n\n\n\n<p>It involves meeting all the TOP requirements, such as the site inspection and submitting compliance certificates from key technical departments.<\/p>\n\n\n<div class=\"wp-block-image wp-image-21772\">\n<figure class=\"aligncenter is-resized\"><img decoding=\"async\" width=\"720\" height=\"332\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2018\/12\/home-loan-jargon-e1543996159877.jpg\" alt=\"People designing plans\" class=\"wp-image-21772\" style=\"width:700px\"\/><figcaption class=\"wp-element-caption\">The TOP can be granted in about four weeks, granted the inspection goes well.<\/figcaption><\/figure><\/div>\n\n\n<p>Any delays in getting the TOP are seldom because of administration; it comes down to how well the developer, and their various contractors, have done the job.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-unlike-the-csc-the-top-is-not-strictly-necessary\"><strong>Unlike the CSC, the TOP is not strictly necessary<\/strong><\/h3>\n\n\n\n<p>One key point to note is that the CSC is <strong>absolutely necessary<\/strong>, whereas the TOP is not. A developer is free to make buyers wait until the CSC if they deem it practical to do so (few do).<\/p>\n\n\n\n<p>However, the CSC is a non-negotiable, and a developer <em>must <\/em>get it at some point (otherwise, well, it&#8217;s illegal to leave half-completed buildings lying around).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-buyers-shouldn-t-count-too-heavily-on-the-top-date\"><strong>Buyers shouldn&#8217;t count too heavily on the TOP date<\/strong><\/h3>\n\n\n\n<p>While most developers will meet their TOP date, it&#8217;s best not to count on it. Delays can happen, and the impact can be significant.<\/p>\n\n\n\n<p>For example, you may end up spending more on temporary accommodations <em>(ironic, we know)<\/em>, if the TOP date is missed. Landlords could also lose tenants and potential rental income.<\/p>\n\n\n<div class=\"wp-block-image wp-image-24724\">\n<figure class=\"aligncenter is-resized\"><img decoding=\"async\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2019\/04\/circling-calendar.jpg\" alt=\"circling a date on a calendar\" class=\"wp-image-24724\" style=\"width:700px\"\/><figcaption class=\"wp-element-caption\">Delays can and do happen, so buyers shouldn&#8217;t rely on TOP dates too much.<\/figcaption><\/figure><\/div>\n\n\n<p>One example of this was the (currently aborted) <a href=\"https:\/\/www.99.co\/singapore\/insider\/laurel-tree-and-sycamore-tree-developer-goes-bust\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sycamore Tree and Laurel Tree condo projects<\/a> &#8211; both developments were meant to TOP in 2016, but were still delayed in 2018. Both have since gone into receivership.<\/p>\n\n\n\n<p>Counting on the TOP date is one risk of buying properties still undergoing development. It often occurs because of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Disputes between the main contractor and the developer<\/li>\n\n\n\n<li>Financial issues (insufficient funds to continue construction)<\/li>\n\n\n\n<li>Supplier disruptions (e.g. the one company that can supply the right marble suddenly closes down)<\/li>\n\n\n\n<li>Stop-work orders issued by authorities like the Ministry of Manpower (often happens if someone is killed or injured on the worksite)<\/li>\n<\/ul>\n\n\n\n<p>In some cases, the property developer will pay damages for going past the stipulated TOP date (check the terms and conditions before you buying).<\/p>\n\n\n\n<p><small><em>[Additional reporting by Jamie Wong]<\/em><\/small><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-would-you-buy-a-property-before-or-after-the-temporary-occupation-period-top-let-us-know-in-the-comments-section-below\">Would you buy a property before or after the Temporary Occupation Period (TOP)?
