We compare the facilities that various condos provide, but less often do we look at the maintenance fees. So condo maintenance fees end up becoming one of the hidden costs of owning a condo.<\/p>\n<p class=\"p1\">But it shouldn\u2019t be overlooked. It is like HDB\u2019s service and conservancy charges (S&amp;CC) in that it\u2019s used to maintain the condo and its facilities.<\/p>\n<p class=\"p1\">The service charge is usually paid every three months to your condo <a href=\"https:\/\/www.99.co\/singapore\/insider\/property-jargon-of-the-day-management-corporation-strata-title-mcst\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">Management Corporation Strata Title (MCST)<\/span><\/a>, which manages your condo.<\/p>\n<p class=\"p1\">A portion of it goes into the condo\u2019s maintenance fund for short-term, day-to-day expenses to keep the facilities in good condition. Another portion of the service charge is for the sinking fund to pay for long-term and large expenditures, such as paint jobs and repairs.<\/p>\n<p class=\"p1\">[Find out more about <a href=\"https:\/\/www.99.co\/singapore\/insider\/sinking-fund-maintenance-fund-and-service-charge\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">the condo maintenance fee here<\/span><\/a> as we explain the differences between the maintenance fund and sinking fund.]<\/p>\n<h2 class=\"p3\"><b>How is the condo maintenance fee determined?\u00a0<\/b><\/h2>\n<p class=\"p1\">Condo maintenance fees differ from condo to condo and depend on various factors. This includes the size of the condo, number of units and facilities. It can range from S$300 to S$500 per month, with the more luxurious condos having a service charge as high as S$1,000 per month.<\/p>\n<p class=\"p1\">For instance, the more facilities your condo has, the higher the amount of money is needed for the maintenance, meaning your service charge will be higher. Like if your condo has a garden at every corner of the development, chances are you\u2019ll need to pay higher maintenance fees. After all, landscaping isn\u2019t cheap.<\/p>\n<p class=\"p1\">Besides these aspects of the condo, how much you pay is determined by your share value.<\/p>\n<h2 class=\"p3\"><b>Share value<\/b><\/h2>\n<p class=\"p1\"><span class=\"s1\"><a href=\"https:\/\/www.bca.gov.sg\/bmsm\/others\/strata_living.pdf\" target=\"_blank\" rel=\"noopener\">Share value<\/a><\/span> refers to the share of the condo development that you own relative to your neighbours. To put it simply, it\u2019s the proportion of the condo that you own.<\/p>\n<p class=\"p1\">The share value is determined based on the floor area of your unit. Or that no one in your five-member household ever uses the fancy gym and swimming pools.<\/p>\n<p class=\"p1\">It works on the assumption that if your unit occupies a larger floor area, chances are you have more people in the household using the condo facilities. Hence, the higher service charge.<\/p>\n<h2 class=\"p3\"><b>Why you shouldn\u2019t default on your condo maintenance fees\u00a0<\/b><\/h2>\n<p class=\"p1\">But even if you don\u2019t use the condo facilities regularly (or don\u2019t even use one at all), you\u2019ll still have to pay the maintenance fee every three months. It\u2019s not just used to ensure that the filtration of the swimming pool works well, but also to keep the common areas clean. More importantly, it funds the costs needed to keep the condo safe.<\/p>\n<p class=\"p1\">It\u2019s also why there are penalties for defaulting on your condo maintenance fee. The last thing we want is a condo management that\u2019s in debt, like the MCST of <a href=\"https:\/\/www.99.co\/singapore\/condos-apartments\/parc-oasis\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">Parc Oasis<\/span><\/a> that <a href=\"https:\/\/www.straitstimes.com\/singapore\/parc-oasis-owners-upset-over-parking-fee-proposal-in-private-condo\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">tried to impose parking fees to cover the shortfall in their maintenance fund<\/span><\/a>.<\/p>\n<p class=\"p1\">Here are the penalties for defaulting on your service charge.<\/p>\n<h2><b>1. You\u2019ll be charged with interest and served with written demand<\/b><\/h2>\n<p class=\"p1\">By right, <a href=\"https:\/\/singaporelegaladvice.com\/law-articles\/what-to-do-if-you-have-a-dispute-with-your-condominiums-management\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">there\u2019s a grace period of 30 days<\/span><\/a> for the condo service charge. If you don\u2019t pay after the grace period, the MCST can charge you interest and even serve you with a lawyer\u2019s letter to recover the payment.<\/p>\n<p class=\"p1\">Depending on the condo, the interest can be as high as 10% to 15% per annum.<\/p>\n<p class=\"p1\">It\u2019s not actually uncommon for people to miss their service charge payment for a month or two. It\u2019s still best not to default on your condo maintenance fee, as the amount can snowball over time with the interest.<\/p>\n<p class=\"p1\">If you face any difficulties paying for it, it\u2019s best to approach your MSCT to discuss and resolve the issue. This will also prevent the situation from escalating.<\/p>\n<h2><b>2. You can be fined up to S$10,000<br \/>\n<\/b><\/h2>\n<p class=\"p1\">Things can get uglier if your MCST sends you a written demand. If you don\u2019t pay your condo maintenance fee within 14 days of receiving the letter, you can be liable for an offence and be fined up to S$10,000.<\/p>\n<p class=\"p1\">To recover the unpaid service charge, the MCST may take you to the Smalls Claims Tribunals or the courts.<\/p>\n<p class=\"p1\">Or worse, they can sell your house.<\/p>\n<h2><b>3. The MCST can sell your house<br \/>\n<\/b><\/h2>\n<p class=\"p1\">This is the last resort and has happened before for some owners. The MCST can register the unpaid management fees as a charge against your property. Doing so gives them the right to sell your unit after the following:<\/p>\n<ul class=\"ul1\">\n<li class=\"li1\">The MSCT passes a special resolution<\/li>\n<li class=\"li1\">A notice of intended sale is published in one or more approved daily newspapers<\/li>\n<li class=\"li1\">No payment and interest is received six weeks after the publication<\/li>\n<li class=\"li1\">There is no legal action pending in court to restrain the MCST from selling the unit<\/li>\n<\/ul>\n<p class=\"p1\">The process is a little different from if you default on your mortgage, in which the bank can repossess your house and put it for auction. Here, the MCST can put your house up for auction while you\u2019re still living in it.<\/p>\n<figure id=\"attachment_41377\" aria-describedby=\"caption-attachment-41377\" style=\"width: 600px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2021\/07\/reasons-why-shouldnt-default-condo-maintenance-fee-arc-at-tampines-scaled.jpeg\" class=\"img-link media-img img-link media-img\"><img decoding=\"async\" class=\"wp-image-41377\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2021\/07\/reasons-why-shouldnt-default-condo-maintenance-fee-arc-at-tampines-scaled.jpeg\" alt=\"Arc at Tampines\" width=\"600\" height=\"400\" srcset=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2021\/07\/reasons-why-shouldnt-default-condo-maintenance-fee-arc-at-tampines-scaled.jpeg 2560w, https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2021\/07\/reasons-why-shouldnt-default-condo-maintenance-fee-arc-at-tampines-1536x1024.jpeg 1536w, https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2021\/07\/reasons-why-shouldnt-default-condo-maintenance-fee-arc-at-tampines-2048x1365.jpeg 2048w, https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2021\/07\/reasons-why-shouldnt-default-condo-maintenance-fee-arc-at-tampines-150x100.jpeg 150w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><\/a><figcaption id=\"caption-attachment-41377\" class=\"wp-caption-text\">Two units at Arc at Tampines were put up for MCST sale after the owners defaulted on the condo maintenance fee.<\/figcaption><\/figure>\n<p class=\"p1\">It\u2019s a way for them to recover the unpaid service charge, and there have been a few cases of this over the years. A recent example is the two units at <a href=\"https:\/\/www.99.co\/singapore\/condos-apartments\/arc-at-tampines\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">Arc at Tampines EC<\/span><\/a>, which were put up as MCST sales after the owners defaulted in the condo maintenance fee.<\/p>\n<p class=\"p1\">There have also been times when the MCST failed to reach this stage of selling the house. In 2019, the MCST of <a href=\"https:\/\/www.99.co\/singapore\/condos-apartments\/sanctuary-green\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">Sanctuary Green<\/span><\/a> <a href=\"https:\/\/www.straitstimes.com\/singapore\/unpaid-condo-maintenance-fees-mc-can-sell-unit-to-recover-sums\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">tried to sell a condo<\/span><\/a> after the owner had failed to pay the service charge multiple times. The bill had come up to more than S$10,000, including interest.<\/p>\n<p class=\"p1\">So the MCST tried to pass a special resolution during its annual general meeting. However, it did not get enough votes to carry out the sale.<\/p>\n<h2 class=\"p3\"><b>Bonus: You can get shamed for not paying, kind of like how loan sharks do it\u00a0<\/b><\/h2>\n<p class=\"p1\">This is outside of what can legally happen, and it\u2019s definitely not something we condone. But it\u2019s happened around 10 years ago. There\u2019s no splashing of red paint, but it\u2019s the same energy as \u201cO$P$\u201d.<\/p>\n<p class=\"p1\">The MCST of <a href=\"https:\/\/www.99.co\/singapore\/condos-apartments\/castle-green\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">Castle Green<\/span><\/a> pasted the name lists of residents on the notice boards next to letter boxes and lifts, detailing the amount of maintenance fee they owed. Of course, residents weren\u2019t too pleased with it.<\/p>\n<p class=\"p4\"><span class=\"s4\"><a href=\"https:\/\/www.99.co\/singapore\/insider\/condo-mcst-resident-fights-singapore\/\" target=\"_blank\" rel=\"noopener\">You can read more about it here.\u00a0<\/a><\/span><\/p>\n<p class=\"p1\">Though we think there\u2019s a low chance of this happening again, especially given the reaction during that time and PDPA regulation these days.<\/p>\n<h2 class=\"p3\"><b>What can you do if you have difficulties paying your condo maintenance fee?\u00a0<\/b><\/h2>\n<p class=\"p1\">Ultimately, selling the property is the last resort that MCSTs want to undertake. And it\u2019s not necessarily beneficial for them to put the property for sale in this way. After all, all they want is to recover the money owed.<\/p>\n<p class=\"p1\">Should you face any difficulties in paying your service charge, it\u2019s best to approach your MCST to negotiate a way to pay the bills. More often than not, you\u2019ll be able to agree with them and avoid losing your home. Like this <a href=\"https:\/\/www.99.co\/singapore\/condos-apartments\/park-green\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">Park Green<\/span><\/a> unit, which was <a href=\"https:\/\/www.straitstimes.com\/singapore\/unpaid-condo-maintenance-fees-mc-can-sell-unit-to-recover-sums\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">initially put up for sale by the MCST in 2019<\/span><\/a>.
