So there\u2019s no need to worry about the lease running out. Save for the dreaded government acquisition, like the <a href=\"https:\/\/www.channelnewsasia.com\/news\/singapore\/north-south-corridor-land-acquisition-thomson-road-building-14632796\" target=\"_blank\" rel=\"noopener noreferrer\">4-storey Thomson Road freehold property that was acquired<\/a> to make way for the North-South Corridor construction.<\/p>\n\n\n\n<p>This extends, to a certain extent, to 999-year leasehold properties as well, since 999 years is certainly long enough to house many generations to come.<\/p>\n\n\n\n<p>The most worrying of the lot though is 99-year <a href=\"https:\/\/www.99.co\/singapore\/insider\/property-jargon-of-the-day-freehold-leasehold\/\" target=\"_blank\" rel=\"noopener\">leasehold<\/a> properties. What rights do owners of this asset class have at the end of the tenure, when the title to the land reverts to its original owners?<\/p>\n\n\n\n<p>For this article, we\u2019ll be focusing on the effect of the lease expiry on private property owners (like <a href=\"https:\/\/www.99.co\/singapore\/condos-apartments\" target=\"_blank\" rel=\"noopener\">condominiums<\/a> and privatised <a href=\"https:\/\/www.99.co\/singapore\/insider\/hdb-affordable-quality-housing\/\" target=\"_blank\" rel=\"noreferrer noopener\">HUDCs<\/a>). As for the 99-year lease of HDB flats, the units will have to be given back to HDB (we\u2019ve written about that <a href=\"https:\/\/www.99.co\/singapore\/insider\/are-hdb-flats-99-year-time-bombs\/\" target=\"_blank\" rel=\"noopener\">here)<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-understanding-the-implications-of-lease-expiry\"><strong>Understanding the implications of lease expiry<\/strong><\/h3>\n\n\n\n<p>As the clock ticks down on a 99-year leasehold property in Singapore, understanding the implications of the lease expiry becomes crucial for homeowners. The end of the leasehold period poses a significant question about the future of the property and the financial implications for the owner.<\/p>\n\n\n\n<p>It&#8217;s essential to recognize that the value of the property may depreciate as the lease shortens, potentially affecting resale value and investment returns. Prospective buyers often weigh the remaining lease period heavily when considering their purchase. Therefore, current owners need to be well-informed about the lease renewal process, the costs involved, and the market trends influencing the desirability of leasehold properties.<\/p>\n\n\n\n<p>This knowledge is not only vital for making informed decisions about future investments but also for understanding the long-term landscape of Singapore&#8217;s real estate market.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-who-does-the-leasehold-revert-to-and-what-happens-then\"><b>Who does the leasehold revert to and what happens then?<\/b><\/h2>\n\n\n\n<p><a href=\"https:\/\/books.google.com.sg\/books?id=G8rACwAAQBAJ&amp;pg=PA76&amp;dq=More+than+three-quarters+of+the+land+in+Singapore+is+state-owned+and+held+by+the+Singapore+Land+Authority+(SLA)+which+acts+as+custodian+of+the+land.&amp;hl=en&amp;sa=X&amp;ved=2ahUKEwj_gumZorP0AhUW7XMBHTZkCB8QuwV6BAgKEAk#v=onepage&amp;q=More%20than%20three-quarters%20of%20the%20land%20in%20Singapore%20is%20state-owned%20and%20held%20by%20the%20Singapore%20Land%20Authority%20(SLA)%20which%20acts%20as%20custodian%20of%20the%20land.&amp;f=false\" target=\"_blank\" rel=\"noopener noreferrer\">More than three-quarters of the land in Singapore is state-owned<\/a> and held by the Singapore Land Authority (<b>SLA<\/b>), which acts as custodian of the land.<\/p>\n\n\n\n<p>On the expiry of a 99-year leasehold, ownership of the land reverts back to the state, and the rights of any property owners are effectively extinguished.<\/p>\n\n\n\n<p>But surely property owners will be entitled to fair compensation for their homes that remain on the property, right?<\/p>\n\n\n\n<p>Unfortunately not. The tough (and some might say unfair) reality is that the SLA has no obligation to reimburse or pay any sort of compensation at all.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-options-do-99-year-leasehold-property-owners-have-then\"><b>What options do 99-year leasehold property owners have then?<\/b><\/h2>\n\n\n\n<p>There are two choices available to 99-year leasehold property owners, both of which involve paying the government a premium to extend the tenure of the lease.<\/p>\n\n\n\n<p>They can either top-up the lease on their land with SLA directly, or sell their property to a third-party developer (known as a collective or <i><a href=\"https:\/\/www.99.co\/singapore\/insider\/property-jargon-of-the-day-en-bloc-sale\/\" target=\"_blank\" rel=\"noreferrer noopener\">en-bloc<\/a> <\/i>sale). Both of these options must be done by all of the owners collectively, and cannot be accomplished on an individual basis.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-lease-top-up\"><b>Lease top-up<\/b><\/h3>\n\n\n\n<p>Here, the property owners apply to the SLA to <a href=\"https:\/\/www.sla.gov.sg\/state-land-n-property\/land-sales-and-lease-management\/lease-management\/lease-policy\" target=\"_blank\" rel=\"noopener noreferrer\">top their lease back up to 99 years again<\/a>, with the payment of a land premium. So for example, if there are 50 years left on the land, owners can top up another 49 years so that the lease reverts back to 99 years.<\/p>\n\n\n\n<p>This premium is assessed by the SLA\u2019s Chief Valuer on a case-by-case basis, taking into account factors such as the number of years remaining in the leasehold.<\/p>\n\n\n\n<p>At this point, it\u2019s at SLA\u2019s discretion whether to approve or reject the application. In making its decision, SLA considers various factors of the lease. It pushes the hefty obligation of the land premium payment to the private developers or companies who are better able to afford it.<\/p>\n\n\n\n<p>The downside is that, unlike a lease top-up, the owners will no longer be entitled to stay in their property as the rights to the lease are transferred to the private developers instead.<\/p>\n\n\n\n<p>What they do get, however, is compensation for their property, which they wouldn\u2019t have been entitled to had their lease simply run its course.<\/p>\n\n\n\n<p>2007 was the peak year for en-bloc sales, including the largest en-bloc sale to date: the sale of Farrer Court apartments (now <a href=\"https:\/\/www.99.co\/singapore\/condos-apartments\/dleedon\" target=\"_blank\" rel=\"noopener\">D&#8217;leedon<\/a>). Its 618 units were sold for a total of S$1.3388 billion dollars, netting each homeowner a cool S$2.122 to S$2.238 million dollars (the original link is now gone, but you can refer to <a href=\"https:\/\/condosingapore.com\/showthread.php\/1701-CapitaLand-buys-Farrer-Court-for-S-1-338-8-million\" target=\"_blank\" rel=\"noopener noreferrer\">this thread<\/a> for the news of the record en-bloc sale).<\/p>\n\n\n\n<figure class=\"wp-block-image alignnone\"><a href=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2021\/11\/d-leedon.jpeg\" class=\"img-link media-img img-link media-img\"><img decoding=\"async\" width=\"920\" height=\"555\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2021\/11\/d-leedon.jpeg\" alt=\"D'leedon\" class=\"wp-image-46031\" srcset=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2021\/11\/d-leedon.jpeg 920w, https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2021\/11\/d-leedon-150x90.jpeg 150w\" sizes=\"(max-width: 920px) 100vw, 920px\" \/><\/a><figcaption class=\"wp-element-caption\">D&#8217;leedon is a redevelopment of Farrer Court, which made headlines for being the largest en bloc sale to date.<\/figcaption><\/figure>\n\n\n\n<p>Then came the en-bloc fever around a decade later from 2016 to 2018.
