These 5 assumptions could land you in trouble."},"content":{"rendered":"<div id=\"bsf_rt_marker\"><\/div>\n<p><span style=\"font-weight: 400;\">There can be several reasons for renting out your HDB flat, such as to earn more cash to cover your monthly expenditure or for passive rental income while you are living in another property (e.g. a condo\/a child&#8217;s apartment). That said, there are a handful of regulations you must know.\u00a0<\/span><\/p>\n\n\n\n<p>One reason for regulating the renting out of flats is to preserve the intention of HDB housing for owner occupation, rather than for investment. The other objective is to preserve the quality of life and living environment of our HDB estates.<\/p>\n\n\n\n<p><span style=\"font-weight: 400;\"><strong>To stay on the right side of the law, you will need to know what you can and cannot do when subletting HDB flats.<\/strong> (FYI: the HDB&#8217;s technical term for flat owners&#8217; is &#8220;tenants&#8221;, hence the term &#8220;subletting&#8221;.) Here are the most common (and wrong) assumptions people make:<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-assumption-1-anyone-can-rent-out-their-flat-after-the-minimum-occupancy-period-mop\"><b>Assumption #1: Anyone can rent out their flat after the Minimum Occupancy Period (MOP)<\/b><\/h2>\n\n\n\n<p><span style=\"font-weight: 400;\">Many HDB flat owners are acquainted with the <a href=\"https:\/\/www.99.co\/singapore\/insider\/property-jargon-of-the-day-minimum-occupancy-period-mop\/\" target=\"_blank\" rel=\"noopener\">MOP<\/a>, where they need to wait at least <em>five years<\/em> before renting out the entire flat. Still, there are certain conditions that one needs to be aware of:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Singapore Permanent Residents (PRs) may not sublet their flat, even if they have fulfilled the MOP.<\/strong><\/li>\n\n\n\n<li><span style=\"font-weight: 400;\">One can, however, rent out spare rooms in their HDB flat even during the MOP, as long as you <a href=\"https:\/\/www.hdb.gov.sg\/residential\/living-in-an-hdb-flat\/for-our-seniors\/monetising-your-flat-for-retirement\/rent-out-your-flat-bedroom\" target=\"_blank\" rel=\"noopener\">get the necessary approval from HDB<\/a>.<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400;\">You will need to check the tenant&#8217;s eligibility to rent the entire HDB flat as well. Since 1 January 2017, non-Malaysian work permit holders from the manufacturing\/process sector are <\/span><a href=\"http:\/\/www.straitstimes.com\/singapore\/new-hdb-rental-rules-for-work-permit-holders\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">no longer allowed to rent the entire HDB flat<\/span><\/a>, joining the list of non-Malaysian work permit holders in the construction and marine industry who may not do so.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-assumption-2-i-can-rent-out-my-flat-during-the-mop-by-keeping-one-room-locked\"><b>Assumption #2: I can rent out my flat during the MOP by keeping one room locked<\/b><\/h2>\n\n\n\n<p><span style=\"font-weight: 400;\">Under HDB rules, it&#8217;s mandatory that the owners and all allowed occupiers to continue to live in the flat with the subtenants during the MOP period. <\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400;\">To skirt around the rule against renting out the entire flat during the MOP, some home-owners rent out the whole flat minus one bedroom, keeping it locked and with the excuse that they are &#8220;frequent travellers&#8221;, if anyone asks.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400;\"><strong>Well, all we can say is that HDB regularly carries out random checks on suspicious rental activity.<\/strong> For instance, when they see that a room rental takes place but the rent is suspiciously high, they will carry out investigations and may enter your flat for checks, to the extent of interrogating your tenant. <\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400;\">If they deem that you have illegally sublet your entire flat, they may take action against you under the <a href=\"https:\/\/sso.agc.gov.sg\/Act\/HDA1959\" target=\"_blank\" rel=\"noreferrer noopener\">Housing &amp; Development Act<\/a>. The worst case scenario is repossession of the flat.<\/span><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\"><a href=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2017\/02\/subletting-hdb-flat-lock-door.jpg\" class=\"img-link media-img img-link media-img\"><img decoding=\"async\" width=\"600\" height=\"400\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2017\/02\/subletting-hdb-flat-lock-door.jpg\" alt=\"subletting hdb flat lock door\" class=\"wp-image-34506\"\/><\/a><figcaption class=\"wp-element-caption\">Try the &#8220;lock one room&#8221; trick at your own risk.<\/figcaption><\/figure><\/div>\n\n\n<h2 class=\"wp-block-heading\" id=\"h-assumption-3-i-can-rent-out-my-hdb-to-more-tenants-if-i-have-a-bigger-flat\"><b>Assumption #3: I can rent out my HDB to more tenants if I have a bigger flat<\/b><\/h2>\n\n\n\n<p><span style=\"font-weight: 400;\">There is a such a thing as an occupancy cap, which specifies the maximum number of occupants in a unit when renting out a HDB flat. FYI, flat owners may not sublet bedrooms for 1-room and 2-room flats, whereas the maximum number of occupiers allowed in a HDB flat is 6, even if you live in a sprawling executive maisonette or a HDB jumbo flat.<\/span><\/p>\n\n\n\n<p><strong>Occupancy Cap for renting out HDB flats<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>HDB Unit Type<\/strong><\/td><td><strong>Maximum allowable bedrooms for renting out<\/strong><\/td><td><strong>Maximum number of occupants permitted in each flat<\/strong><\/td><\/tr><tr><td>3-room<\/td><td>1<\/td><td>6<\/td><\/tr><tr><td>4-room and larger<\/td><td>2<\/td><td>4<\/td><\/tr><\/tbody><\/table><figcaption class=\"wp-element-caption\">Source: HDB<\/figcaption><\/figure>\n\n\n\n<p>If renting out rooms, the stay-in landlord and any other non-tenants in the house will also count towards the occupancy cap.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-assumption-4-i-do-not-need-to-register-a-tenant-if-he-she-is-my-relative-or-friend\"><b>Assumption #4: I do not need to register a tenant if he\/she is my relative or friend<\/b><\/h2>\n\n\n\n<p><span style=\"font-weight: 400;\">As long as you are collecting rent for someone&#8217;s stay in your flat, you will need to register the tenant. This is to ensure the person is legally allowed to stay in Singapore, and that the subletting quota for the neighbourhood is observed. &nbsp;<\/span><\/p>\n\n\n\n<p><strong>FYI, there is a limit on the number of foreigners and non-Malaysian Singapore PRs who may live in a block of flats.<\/strong> The current quota for non-Malaysian tenants is set at 8% at the neighbourhood level and 11% at the block level. Landlords should <a href=\"https:\/\/services2.hdb.gov.sg\/webapp\/BR12AWNCQuota\/BR12PEnquire.jsp\" target=\"_blank\" rel=\"noopener\">check here<\/a> before renting out their flat.<\/p>\n\n\n\n<p><span style=\"font-weight: 400;\">If you are renting a HDB flat\/room to a friend or relative who is a Singaporean, you need to ensure that they do not currently own other HDB properties as well, unless they are divorced or rent out their property within one month of renting a flat\/bedroom from you.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-assumption-5-i-can-rent-out-the-hdb-flat-room-to-the-same-tenant-for-as-long-as-i-want\"><b>Assumption #5: I can rent out the HDB flat\/room to the same tenant for as long as I want<\/b><\/h2>\n\n\n\n<p><span style=\"font-weight: 400;\">HDB flats are public housing primary for Singaporeans&#8217; own stay. If you are thinking of renting them out long term to the same tenant, that is not allowed. <strong>Although the maximum subletting period is 3 years per application, it is reduced to 2 years if one or more subtenants is a non-Malaysian\/non-citizen. <\/strong><\/span><\/p>\n\n\n\n<p>Each time you rent out your flat or renew the rental application, you need to reapply for approval. <\/p>\n\n\n\n<p><span style=\"font-weight: 400;\">You can, however, rent out the HDB flat or room continuously to a different tenant each time. FYI, <strong>the minimum subletting period for a HDB room or whole flat is 6 months per application.<\/strong><\/span><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\"><a href=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2018\/09\/renting-in-singapore-landlords-reject-tenants.jpg\" class=\"img-link media-img img-link media-img\"><img decoding=\"async\" width=\"720\" height=\"480\" src=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2018\/09\/renting-in-singapore-landlords-reject-tenants.jpg\" alt=\"Old man crossing his arms in an X\" class=\"wp-image-19709\" srcset=\"https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2018\/09\/renting-in-singapore-landlords-reject-tenants.jpg 720w, https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2018\/09\/renting-in-singapore-landlords-reject-tenants-600x400.jpg 600w, https:\/\/www.99.co\/singapore\/insider\/wp-content\/uploads\/2018\/09\/renting-in-singapore-landlords-reject-tenants-440x294.jpg 440w\" sizes=\"(max-width: 720px) 100vw, 720px\" \/><\/a><figcaption class=\"wp-element-caption\">Screen your tenants carefully, with the help of an agent if necessary to save you time.<\/figcaption><\/figure><\/div>\n\n\n<h2 class=\"wp-block-heading\" id=\"h-assumption-6-if-i-rent-out-the-entire-hdb-flat-i-am-not-liable-for-what-my-tenant-does\"><b>Assumption #6: If I rent out the entire HDB flat, I am not liable for what my tenant does<\/b><\/h2>\n\n\n\n<p>Your tenant may not sublet the rooms in the HDB flat he\/she rents. If they do, or flout any law while living in your flat, the HDB flat owner may be held liable.<\/p>\n\n\n\n<p>Under the Women\u2019s Charter, for instance, an owner, or tenant who rents out\u2060 \u2013 or sublets\u2060 \u2013 premises that are used as a brothel will be held criminally liable.<\/p>\n\n\n\n<p><span style=\"font-weight: 400;\"><strong>Hence, it&#8217;s prudent that the landlord interviews all prospective tenants face-to-face (or via video call).<\/strong> Frequent checks of the property, such as a visit once every two months, are also recommended to make sure that there are no unauthorised occupants and nothing fishy\/illegal is happening behind closed doors. <\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400;\">If you are unavailable (e.g. overseas), you can ask someone you trust to do these checks.<\/span><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-have-questions-about-subletting-your-hdb-flat-ask-us-in-the-comments-below\"><strong>Have questions about subletting your HDB flat?
