If you\u2019re on a tight budget, or just hate the thought of living by yourself, you might look into room renting in a home with like-minded roommates. <\/span>And while the price may be right, we\u2019ve seen a lot of complaints from suffering tenants here at <\/span>99.co<\/span><\/a>, so here are a few things you should know if you\u2019re thinking of room renting in Singapore.<\/span><\/p>\n

Landlords entering your room without permission<\/b><\/h3>\n

This is one of the biggest and most shocking complaints we\u2019ve heard time and time again: Landlords entering their tenants\u2019 room without their permission or knowledge.<\/p>\n

It\u2019s an open secret that the law favours landlords here in Singapore, and it\u2019s unfortunately the case here. Legally, a landlord may enter any part of his property \u2013 even a room that has been leased out. <\/span><\/p>\n

That\u2019s why it\u2019s so important to have clear language in your tenancy agreement surrounding this. While you may not have the police on your side, you\u2019d at least have contractual remedies to such behaviour by your landlord. <\/span><\/p>\n

Include a clause in your rental agreement that: <\/span><\/p>\n

    \n
  1. requires the Landlord to first get your written consent should he wish to enter your premises;<\/span><\/li>\n
  2. sets out a minimum notice period that he must provide you (e.g. 24 hours or longer); <\/span><\/li>\n
  3. lists the situations in which he can seek such consent to enter (e.g. to conduct repairs or show the unit to potential tenants); and<\/span><\/li>\n
  4. imposes a consequence to the landlord breaching the clause (e.g. you would may end the tenancy immediately, or perhaps with a certain number of months\u2019 notice). It should be clarified that your security deposit should be returned to you under the terms of the agreement should this occur.<\/span><\/li>\n<\/ol>\n

    The landlord will most ask for certain exceptions to the rule, such as where emergency repairs are required which, if delayed, would damage the property, or if he suspects you are breaching the terms of the tenancy agreement – these are standard and fair exceptions. <\/span><\/p>\n

    Master Tenants Renting Out Rooms<\/b><\/h3>\n

    When room renting, always ensure that you\u2019re dealing with the owner of the property (or his agent), and not just a master tenant. <\/span><\/p>\n

    Master tenants should not be subletting rooms in the unit unless the landlord has explicitly allowed them to do so, and this is unheard of as landlords usually want control over who stays at their property. Even then, you must insist on having your name added to the main lease.<\/span><\/p>\n

    In 2009, a <\/span>master tenant illegally-partitioned a maisonette unit without the owner\u2019s knowledge, and sublet it to 11 other tenants<\/span><\/a>. When the subletting was eventually discovered by the owner, the tenants were left with no recourse when served with eviction notices and told to move out of the property since they had no contract with the actual owner. <\/span><\/p>\n

    To avoid this, check that the person you\u2019re dealing with is in fact the owner by having them log into their \u201c<\/span>MyHDBPage<\/span><\/a>\u201d (for HDBs), or via the <\/span>Singapore Land Authority\u2019s MyProperty service<\/span><\/a> which should have details of the properties owned by them<\/span>. <\/span><\/p>\n

    If you\u2019re dealing with the master tenant, make sure that you have your names added to the main tenancy agreement that the master tenant is under and signed off by the owner.<\/span><\/p>\n

    Failing to do this could leave you not only out of home, but out of any security deposit paid as well.<\/span><\/p>\n

    What are some important things you should know about renting rooms in Singapore?<\/figcaption><\/figure>\n

    Overcrowded Rooms<\/b><\/h3>\n

    Many tenants have also complained of overcrowded rooms and cramped conditions in their apartments. Just last year, a <\/span>3-room flat in Teban Gardens was alleged to have had about 20 tenants<\/span><\/a> staying in it!<\/span><\/p>\n

    HDB flats and private residences have strict rules for the number of people who can stay in them, as well as specific partitioning regulations, so be on your guard if you find any kind of partitioning in the home.<\/span><\/p>\n

    HDB Flats<\/strong><\/p>\n

    Only owners of 3-room or bigger flats may sublet their bedrooms. <\/span><\/p>\n

    There are also rules regarding the number of bedrooms that flat owners can sublet, and the maximum number of occupants who can stay in each flat: <\/span><\/p>\n\n\n\n\n\n

    ^ Only bedrooms originally constructed by HDB can be rented out. All other parts of the flat (including partitioned rooms) cannot be used as bedrooms for subtenants.<\/span><\/p>\n

    *Occupants include owners, authorised occupiers, and subtenants.<\/span><\/p>\n

    Private Properties<\/strong><\/p>\n

    If you\u2019re looking to sublet a room, make sure the room isn\u2019t part of a partitioned space. Under <\/span>URA regulations<\/span><\/a>, owners may not rent out individual rooms that have been created out of internal partitioning works because of the safety concerns of overcrowding. <\/span><\/p>\n

    A residential unit is also only allowed to house a maximum of 8 occupants, no matter the size of the unit, which includes the owner if he is living on the premises. Each occupant must also have at least 10sqm of space. These two rules don\u2019t apply, however, if the entire unit is occupied by a family who isn\u2019t renting out the premises. <\/span><\/p>\n

    Lease Must Be For at Least 6 Months<\/b><\/h3>\n

    Be wary if you\u2019re being offered a lease for less than 6 months \u2013 whether it\u2019s an <\/span>HDB flat<\/span><\/a> or <\/span>private property (unless the owner’s received clearance from the Urban Redevelopment Authority to do so)<\/span><\/a> – these are illegal as the law requires a lease be at least 6 months. <\/span><\/p>\n

    Living With Your Landlord<\/b><\/h3>\n

    Room renting with roommates is awkward enough, but it\u2019s always a little more awkward when your roommate is your landlord as well – it gets a lot more difficult to complain about a roommate\u2019s unreasonable behaviour when he has the power to end your lease. <\/span><\/p>\n
