Understanding HDB leased land

HDB flats in Singapore are constructed on land leased from the government for a 99-year period. Though HDB flat owners may live in and use their flats, the government still owns the land they’re built on. Eligibility criteria for subletting

Before considering subletting, flat owners must meet specific eligibility conditions:

  • Citizenship: Only Singapore Citizens may sublet their entire HDB flat. Singapore Permanent Residents may not do so.
  • Minimum Occupation Period (MOP): Owners must have occupied their flat for at least five years before applying to sublet the whole unit.
  • Flat type: Owners of 3-room or larger flats can rent out spare bedrooms, provided they continue to live in the flat during the rental period.

Application process

To sublet an HDB flat or bedroom, owners must follow these steps:

  1. Seek approval: For subletting the entire flat, prior approval from HDB is mandatory. Applications can be submitted online via the HDB website.
  2. Provide tenant details: Owners must furnish details of all tenants, including identification and immigration status.
  3. Pay administrative fees: An administrative fee is payable with each application.
  4. Receive approval: Upon approval, owners will receive an official letter showing the rental period and conditions.

Regulations and conditions

Several regulations govern the subletting of HDB flats:

  • Rental period: The minimum rental period is six months per application. The maximum is three years if all tenants are Singaporeans or Malaysians, and two years if any tenant is a non-Malaysian non-citizen.
  • Occupancy cap: To prevent overcrowding, there are limits on the number of occupants:
    • 1-room and 2-room flats: Maximum of four occupants.
    • 3-room flats: Maximum of six occupants.
    • 4-room and larger flats: Maximum of eight occupants.
  • Non-Citizen Quota: To maintain a balanced ethnic mix, there is a Non-Citizen Quota for renting out flats. If the quota is reached in a neighbourhood or block, only Singaporeans and Malaysians can rent flats there. This quota does not apply to the renting out of bedrooms.

Responsibilities of flat owners

Owners who sublet their flats have specific responsibilities:

  • Ensure tenant eligibility: Verify that tenants are legally living in Singapore and possess valid passes.
  • Compliance with regulations: Ensure that tenants adhere to all HDB regulations and do not engage in unauthorised activities.
  • Inform HDB of changes: Notify HDB of any changes in tenancy, including renewals or terminations, within seven days.
  • Maintain the flat: Ensure that the flat is well-maintained and that tenants do not cause disturbances to the neighbourhood.

Consequences of non-compliance

Failure to adhere to HDB’s subletting regulations can cause serious consequences:

  • Financial penalties: Owners may be fined for unauthorised subletting or breaches of regulations.
  • Repossession of flat: In severe cases, HDB may compulsorily gain the flat.
  • Legal action: Owners may face legal proceedings under the Housing & Development Act.
